IMPORTANT - AUSTRALIAN CONSUMER LAW

These Terms and Conditions are subject to the Australian Consumer Law (ACL). The ACL provides consumer guarantees that cannot be excluded, restricted, or modified by these Terms. If any provision of these Terms conflicts with your rights under the ACL, the ACL will apply. Nothing in these Terms limits your statutory rights as a consumer.

 


 

1. AGREEMENT TO TERMS

By accessing, browsing, or using this website and making a purchase, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, please do not use our website or make a purchase.

You represent that:

  • Goods must be as described or match any sample or demonstration model

  • Goods must be fit for any particular purpose you made known to us

  • These guarantees cannot be excluded and apply regardless of how long ago you purchased the product

For Services (if applicable):

  • Services must be provided with due care and skill

  • Services must be fit for any particular purpose you made known to us

  • Services must be completed within a reasonable time

Your Rights Under Consumer Guarantees

If a product has a MAJOR failure: You are entitled to choose either a refund, replacement, or repair. A major failure includes:

  • A serious problem that would have stopped you from buying the product

  • Safety issues

  • The product being significantly different from the description, sample, or demonstration

  • The product being unsafe or unable to be used for its expected purpose

If a product has a MINOR failure: We may offer repair or replacement. If we cannot fix it within a reasonable time, you can request a refund.

Time Limits:

  • You can claim a remedy within a reasonable time after discovering the problem

  • There is no set timeframe (e.g., 30 days, 1 year) - it depends on the nature of the product and how soon you notice the problem

  • For most goods, claiming within 1-2 years is generally considered reasonable

 


 

3. PRODUCTS AND DESCRIPTIONS

We have made every effort to provide accurate product descriptions, images, and pricing on our website. However:

  • Product appearance may differ from images due to your device settings, screen resolution, or color calibration

  • We do not warrant that product appearance, color, or quality will exactly match how it appears on your screen

  • All product descriptions and prices are subject to change without notice

  • We reserve the right to discontinue any product at any time

  • We reserve the right to limit quantities per customer or by location

Any errors or inaccuracies in product information do not affect your consumer rights under the ACL.

 


 

4. ORDERING AND PAYMENT

  3. Your order is accepted once we confirm and process payment

  4. We may decline any order at our sole discretion

You represent and warrant that:

  • Your purchases are for personal or household use only, not for resale or commercial purposes

  • All payment and delivery information is accurate and complete

  • You are authorized to use any payment method provided

Payment

  • Prices displayed include GST (where applicable) but may not include shipping

  • Payment must be received and processed before your order is accepted

5. SHIPPING AND DELIVERY

    • Customs clearance

Responsibility

We are not liable for any shipping delays, lost shipments, or delivery failures caused by the carrier or other circumstances beyond our control.

If your item doesn't arrive:

  2. We will investigate with the carrier

  3. If the item is lost, we will arrange a replacement or refund

 


 

6. RETURNS AND REFUNDS POLICY

Australian Consumer Law Guarantees

All products sold by Restvara are covered by the Australian Consumer Law (ACL). ACL guarantees apply automatically to all purchases and cannot be excluded. If a product has a major defect, is unsafe, or significantly differs from our description, you're entitled to a refund or replacement—regardless of how long ago you purchased it. For minor defects, we'll offer to repair, replace, or refund at our discretion.

30-Day Change of Mind Returns

If you change your mind about a purchase, you can request a return within 30 days of delivery. To be eligible:

  • The item must be unused and unopened (or in resaleable condition)

  • Original tags must be attached

  • Item must be in original packaging

  • You must have proof of purchase

Return Shipping: Return shipping costs are the customer's responsibility for change of mind returns. We recommend using tracked shipping so you can monitor your return.

Refund Processing: Once we receive your return and inspect the item to verify it meets the above conditions, we'll process your refund within 5 business days. Please allow an additional 5-10 business days for your bank to deposit the funds into your account.

Items Not Meeting Conditions: If your returned item doesn't meet the eligibility requirements above (e.g., opened, tags removed, damaged beyond normal handling), we may decline the return or deduct a reasonable restocking fee (up to 10% of the purchase price) to cover inspection and restocking costs.

How to Start a Change of Mind Return

  2. We'll confirm whether your return is accepted

  3. We'll provide you with return instructions and our return address

  4. Send your item to the address we provide

  5. Include your order number in the parcel

  6. Use tracked shipping

Items sent without prior approval will not be accepted and will not be refunded. We will not accept responsibility for lost or damaged items sent without authorization.

Damaged or Faulty Items

If your item arrives damaged, defective, faulty, or incorrect, contact us immediately at restvarasupport@gmail.com We will:

  • Arrange a replacement or refund at no cost to you

  • Cover all return postage

  • Process your claim promptly

Provide photos of the damage/defect if possible to help us process your claim faster.

Refund Timeline

Once your return is approved:

  • Refund is processed within 5 business days of inspection

  • Your bank/payment provider may take additional time to process

  • If you haven't received your refund after 15 business days, contact us immediately
